These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of our e-commerce store, custom AI creation services, social media viral contest programs, and print-on-demand fulfillment.

By creating an account, browsing our website, generating designs, placing an order, or submitting a contest claim, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our services.

1. Store Operation & Account Registration (WordPress & WooCommerce)

1.1. Account Creation: To access certain features—including saving generated AI artworks, viewing order histories, accumulating viral contest raffle tickets, and participating in referral claims—you must register an account through our WordPress/WooCommerce system. You agree to provide accurate, current, and complete information during registration.

1.2. Account Security: You are strictly responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or breach of security.

1.3. Order Acceptance: All orders placed through WooCommerce are subject to acceptance and availability. We reserve the right to cancel or refuse any order at our sole discretion (for reasons including price errors, suspected fraud, or violations of our content guidelines).

 

2. Custom AI Image Generation (Printive AI Image Generator)

2.1. AI Generation Service: Our platform empowers users to input textual prompts and generate customized visual designs via an integrated Artificial Intelligence rendering engine for print-on-demand physical products (e.g., t-shirts, canvas prints, mugs, hoodies).

2.2. Content Guidelines & Prohibited Prompts: You agree not to submit textual prompts or source images that generate content which is:
– Infringing on third-party copyright, trademark, patent, or proprietary rights;
– Obscene, sexually explicit, pornographic, defamatory, hateful, or harassing;
– Promoting illegal activities, violence, or unlawful discrimination;
– Violating any local or international laws.
We reserve the right to block prompts, discard designs, or terminate user accounts violating this standard without previous notice.

2.3. Intellectual Property Rights & License:
– User Ownership & License: By generating artworks using our AI tools, you retain non-exclusive usage rights to your created designs for personal enjoyment or ordering physical goods through our platform.
– Grant of License to Us: By utilizing our AI design tools and completing purchases, you grant our store a worldwide, perpetual, royalty-free, transferable license to reproduce, print, package, publish, and showcase your AI-generated printed items for fulfillment, analytical training, and promotional marketing purposes across our catalog and digital channels.
– Nature of AI Art: You acknowledge that AI-generated imagery relies on complex algorithms and public machine learning datasets. Similar or identical outputs may be generated by other users; you cannot claim sole exclusive artistic rights against unrelated third parties producing comparable outputs.

2.4. Creative Quotas, Rate Limiting & Fair Use Policy:
– 2.4.1. Guest Visitor Quota: Unregistered guest visitors are granted access to generate two (2) AI designs per rolling six (6) hour window, enforced via IP tracking, device fingerprints, and temporary session tokens. Guest creations are restricted to standard apparel categories (T-Shirts, Hoodies). Temporary designs generated by guest users are subject to automatic cache cleanup after twenty-four (24) hours unless converted into a completed order or claimed by a newly registered account.
– 2.4.2. Free Registered Member Quota: Registered members with active, non-paying accounts receive three (3) complimentary generation allowances per rolling six (6) hour replenishment interval. Free accounts unlock access to extended standard apparel (Sweatshirts, Canvas prints), personal design history (retained for up to seven (7) days unless ordered or featured in our public showcase), and multi-image merge functionality (up to 3 source layers). Unused promotional generations do not accumulate or carry over beyond the maximum ceiling of three (3) credits per interval and carry no cash surrender value.
– 2.4.3. Paid VIP Credits & Quota Packages: Users may purchase prepaid generation credit bundles (Basic, Pro, Premium) to unlock high-volume, on-demand AI generation free from the six-hour interval restriction. Paid VIP status unlocks luxury all-over-print (AOP) product templates (Bomber Jackets, Duffle Bags, Blankets, All-Over Print Tees), and enhanced multi-image compositing (up to 6 source layers). All purchased generation credits are non-refundable once computational processing and GPU rendering cycles have commenced.
– 2.4.4. Fair Use, Anti-Abuse & Rate-Limit Circumvention: Any attempt to circumvent rate limits, quotas, or platform security—including but not limited to the deployment of automated scrapers, bots, multi-account registration farms, headless browsers, rotating proxy networks, or VPNs to manipulate guest or free tier allocations—is strictly prohibited and constitutes a material breach of these Terms. We reserve the absolute right to throttle requests, revoke promotional or purchased credits, blacklist offending IP subnets, and terminate associated accounts without notice or financial liability.

2.5. Artwork Storage & Cloud Data Retention Policy:
To ensure platform scalability, storage hygiene, and resource optimization, all generated visual assets, temporary canvas edits, and custom print files are governed by the following automated lifecycle rules:
– 2.5.1. Purchased / Ordered Products (30 Days Retention): Any custom AI artwork linked to a completed or paid WooCommerce print order is securely retained on our cloud storage for thirty (30) calendar days from the date of purchase. This 30-day window guarantees seamless manufacturing verification, order fulfillment with printing provider, access to high-resolution (300 DPI) print-ready files in the “My Ordered AI Designs” customer portal, and expedited reprint processing in the event of courier damage.
– 2.5.2. Registered User / Member Creations (7 Days Retention): Unpurchased artwork designs generated by logged-in users (Free Members and Paid VIP Creators) are preserved in the user’s account gallery (“My Recent AI Artworks”) for seven (7) calendar days from generation. During this period, users may download, edit, remix, or forward the design to the Mockup Studio to configure physical merchandise. After seven (7) calendar days, unpurchased designs are permanently purged by automated cleanup maintenance, unless specifically curated into our public Featured Showcase (Immunity Guard).
– 2.5.3. Guest / Non-Login Visitors (24 Hours Retention): Temporary designs, scratchpad layers, and unauthenticated sessions generated by visitors without logging in are stored in temporary cache storage for twenty-four (24) hours only. After 24 hours, guest temporary files are permanently purged. To prevent loss of creative work, guest visitors must register an account or complete a product checkout before the 24-hour expiration window closes.

2.6. Automated Prompt Content Moderation, Censorship Filter & Quota Protection Policy:
To ensure community safety, adhere to our manufacturing partner’s acceptable use standards, comply with external AI engine provider policies (OpenAI & Google Gemini), and maintain brand integrity, all textual descriptions and instructions entered into our AI generation, editing, and merging tools are governed by an automated real-time Content Moderation Filter:
– 2.6.1. Prohibited Content Categories: We strictly prohibit prompts containing terms or concepts falling within the following categories:
* Sexually Explicit & NSFW: Graphic anatomical depictions, pornography, erotica, non-consensual sexual themes, and fetishistic content;
* Violence, Gore & Harm: Dismemberment, severe bloodshed, mutilation, suicide, self-harm, torture, mass violence, and animal cruelty;
* Hate Speech & Extremism: Promotion of violence, white supremacy, neo-nazism, terrorist affiliations, anti-Semitic symbols, or dehumanizing speech targeting protected characteristics (race, ethnicity, religion, disability, sexual orientation, or gender);
* Illegal Substances & Weapons: Illicit narcotics, methamphetamine, fentanyl, counterfeit currency, untraceable ghost guns, pipe bombs, or instructions for weapon synthesis;
* Abusive Profanity & Vulgarities: Malicious insults, gratuitous profanity, and abusive vulgar slurs.
– 2.6.2. Two-Tier Verification Architecture: The content moderation system operates in two synchronized layers: (a) Client-side pre-filtering running directly within your web browser to provide instant feedback prior to network dispatch, and (b) Server-side regex boundary inspection (`\b…\b`) running in our backend before processing. Precise boundary matching prevents false positives, ensuring that standard apparel terminology (such as “classic fit” or “unisex t-shirt”) is never mistakenly flagged.
– 2.6.3. Enforcement Modes: If a prohibited term is detected, the system will apply one of two administrative enforcement actions:
* Block & Warn (Default): The generation request is immediately aborted, a clear explanatory notice is presented, and the prompt is not submitted to external AI computing clusters;
* Masking: Where enabled, the prohibited term is automatically sanitized and replaced with asterisks (`***`) before being forwarded to the generation engine.
– 2.6.4. Absolute Credit & Quota Protection Guarantee: Content moderation screening is strictly executed BEFORE any generation credit deduction or rate-limit accounting takes place. If your prompt is rejected or blocked by our content moderation filter, zero (0) credits are burned from your account, and your generation allowance remains 100% intact. We believe in creative education and will never penalize your paid or promotional balance for an intercepted prompt.
– 2.6.5. Anti-Circumvention Rule: Intentionally attempting to evade, trick, or bypass the content filter—including through the use of intentional character spacing, obfuscation, phonetic substitution, leetspeak, homoglyphs, or invisible unicode characters—is strictly forbidden and may result in immediate suspension or permanent termination of your account privileges without refund.

3. Print-on-Demand Fulfillment & Shipping

3.1. Manufacturing Partner: All custom physical products generated on our platform are manufactured, printed, packaged, and dropshipped via our third-party fulfillment partner.

3.2. Production & Shipping Timelines: Products are made to order upon checkout completion. Production (processing) takes 2-5 business days. Standard shipping for the US takes an additional 3-5 business days, and Canada takes 5-10 business days. Total estimated delivery time is 5-10 business days for the US and 7-15 business days for Canada. We are not responsible for delays caused by postal couriers, customs processing, or external force majeure events.

3.3. Customs, Duties, & Import Taxes: International orders delivered across borders may be subject to customs duties, VAT, or local tax assessments. The recipient/buyer is entirely responsible for settling any applicable local taxes upon delivery.

3.4. Returns, Replacements & Refund Policy:
– Made-to-Order Rule: Because every item is uniquely printed on-demand according to your specific AI design configuration and garment sizing selections, we cannot accept returns or issue refunds for buyer’s remorse, incorrect size selections, or typographical errors made during creation.
– Defective or Damaged Goods: If your physical order arrives damaged, defective, or misprinted due to production faults during manufacture’s printing process, you must submit a claim along with photographic evidence within 30 calendar days of product delivery. Upon positive verification, we will issue a free reprint/replacement or credit without requiring physical returns of damaged items.

3.5. Stock Availability & Substitutions: To ensure the fastest delivery times, in the rare event that a specific garment model becomes temporarily out of stock at our fulfillment centers, you agree that we reserve the right to automatically substitute the apparel with an equivalent or higher quality alternative. The color and size you order will be matched as closely as possible to remain exactly the same. This automated process guarantees your order is fulfilled without unexpected delays.

3.6. Product Visuals, Advertising Materials & Specification Precedence:
– Advertising & Promotional Disclaimers: You acknowledge and agree that all promotional images, videos, commercial advertisements, social media campaigns, lifestyle photography, and digital 2D/3D mockups displayed across external marketing channels (including Meta Ads, Facebook, Instagram, Google Ads, YouTube, TikTok) or on our website are for artistic illustration, concept visualization, and styling inspiration purposes only. Due to natural screen calibration variations, mobile display settings, ambient studio lighting, and print-on-demand manufacturing tolerances, actual delivered physical merchandise and printed colors may slightly vary from digital video representations or promotional visuals.
– Absolute Precedence of Product Page Descriptions: The sole accurate, governing, and legally binding source of technical product specifications—including exact garment blank model, fabric composition, material weight (e.g., 7.5 oz/yd² heavyweight cotton, 8.0 oz fleece), sizing charts, fit profile, seam construction, care instructions, and finish details—is strictly the official written text and specification table displayed on the respective individual product description page on our website (printive.art). In the event of any perceived difference, conflict, or discrepancy between promotional advertising materials (videos, banners, social posts) and the product page specifications, the product page description shall strictly govern and supersede all external representations.

3.7. DTG Printing Disclaimers & Production Limitations:
– We do not print white ink on white garments.
– Light ink elements on bright-colored garments may appear tinted due to the curing process and product dye. This is most evident in Red, Maroon, and other similarly-colored garments.
– Graphics with hard lines or symmetrical shapes may have slight variations due to the manual printing processes, and a minimal shrinkage per print location is possible due to different material compositions.
– Any minor discoloration of the product or stains around the printed image will disappear after the first wash.
– Some smaller youth/women products can have their inside labels positioned a bit lower than typical due to a printing process limitation.
– Human involvement in the printing process can lead to minor variations in the exact placement of prints on garments and products.
– We do not ship blank products.

4. Viral Contest & Monthly Raffle (Printive Viral Contest)

4.1. Program Overview: Our platform hosts an exciting viral marketing contest encouraging customers to share their printed AI creations on social media (Instagram, TikTok, Facebook) for opportunities to win cash-value prizes or store credits in USD every month.

4.2. Eligibility & Participation: Open to registered customer accounts who have purchased at least one product featuring Printive AI artwork. Void where prohibited or restricted by local sweepstakes/raffle legislation.

4.3. How to Earn Raffle Tickets:
– Purchase Rewards: Upon an order’s status moving to Completed (or Processing), users automatically receive a designated number of active raffle tickets per individual Printive AI item purchased.
– Social Share Bonus: Users can earn bonus tickets by sharing a public video, Reel, or photo post of their physical design on supported social media platforms containing our required campaign hashtag and official tag.

4.4. Submission & Claim Verification: Claims must be submitted via the designated URL-submission form in the WooCommerce My Account portal (Share & Earn Tickets tab). Each completed order is eligible for one (1) claim per supported social media platform (maximum 3 platforms). Submitted URLs undergo pre-validation and moderation. We retain the right to audit, revoke, or disqualify bonus tickets obtained via private links, deleted posts, counterfeit engagement, or spam tactics.

4.5. Dual-Target Threshold Mechanism: The monthly drawing is activated once community goals are collectively met (default: 1,000 AI orders AND 1,000 approved social share claims). If monthly targets are not reached by the close of the calendar month, active tickets will either automatically expire or carry over to the subsequent billing cycle depending on active store configurations. Administration reserves the right to execute a force override draw for promotional flexibility.

4.6. Winner Selection & Prize Allocation: Winners are drawn via a cryptographically secure random number extraction engine operating over an array pool where user tickets are proportionally duplicated according to ticket balance. A single user account can win at most one (1) prize rank (e.g., 1st, 2nd, or 3rd Place) per monthly draw. All drawing results generated and verified by our system are final, legally binding, and non-negotiable.

4.7. Prize Claim & Notification: Winners are notified via automated HTML email to their registered WordPress email address within seventy-two (72) hours of drawing execution. Winners must reply to support instructions within fourteen (14) calendar days to claim their prize. Failure to respond in time forfeits the award. Prizes are non-transferable and subject to tax documentation requirements depending on the recipient’s jurisdiction.

4.8. Publicity & Winner Announcements: By participating in the contest, you explicitly grant us permission to list your display name, winning prize tier, ticket count, and submitted social media links on our public winners shortcode widgets, leaderboards, and promotional advertising campaigns without further compensation.

5. Third-Party Analytics & Marketing Services (Google & Meta Ads)

5.1. Tracking & Optimization: You acknowledge and agree that our online store integrates third-party marketing and analytical measurement tracking tools, including Google Analytics, Google Ads Conversion Tags, and the Meta Ads (Facebook & Instagram) Pixel.

5.2. Remarketing Campaigns: We reserve the right to utilize anonymized browsing behavior, shopping cart interactions, and completed order metrics gathered by these third-party trackers to serve targeted advertisements across external ad networks (Google Display Network, Search, Facebook, Instagram) after you leave our website. You may manage or opt-out of ad tracking as outlined in our accompanying Privacy Policy.

5.3. Advertising Content & Visual Representation Disclaimers: All advertising creatives, video ads, commercial storyboards, and marketing materials displayed on third-party ad networks (Meta Ads, Facebook, Instagram, Google Ads, TikTok) are governed by the visual disclaimers and product description precedence set forth in Section 3.6 of these Terms.

6. Indemnification & Limitation of Liability

6.1. Indemnification: You agree to defend, indemnify, and hold harmless our store, its operators, officers, developers, and manufacturing partners against any claims, damages, losses, liabilities, and legal fees arising out of your breach of these Terms, unauthorized third-party content included in your AI prompts, or illegal usage of our platform.

6.2. Limitation of Liability: In no event shall our total aggregate liability arising out of or related to your order or usage of our web applications exceed the amount actually paid by you for the individual physical product giving rise to the dispute. We shall not be liable for indirect, punitive, or consequential damages, loss of social media engagement, or unreceived raffle rewards due to email delivery failures.

7. Governing Law & Modifications

7.1. Governing Law: This Agreement shall be construed, interpreted, and governed by the standard commercial regulations applicable in the operating jurisdiction of the online store owner, without regard to conflicts of law principles.

7.2. Modifications: We reserve the right to review, update, or revise these Terms at any time. Changes become immediately effective upon publication on this website. Continued usage of our AI creation tools or contest features constitutes acceptance of updated amendments.
